OpenDance Madeira School Rules

Please read these rules carefully before using Our Service. By enrolling in a class or attending an event, you agree to comply with these terms.

1. Payment Policy

Monthly Payments

  • Payment for classes must be made in full before the 4th day of each month.
  • Prices include VAT (IVA) at the current regional rate unless otherwise stated.

Discounts

  • Students, retirees, and unemployed individuals are eligible for discounts on course fees.
  • To receive a discount, a valid ID card or an official certificate from the relevant institution must be presented at the time of registration.
  • Responsibility: It is the student’s responsibility to provide proof of eligibility before payment. Discounts cannot be applied retroactively.

2. Class Schedule and Cancellations

Holidays and Closures

  • The dance school will be closed on Portuguese national and regional holidays.
  • There is no obligation to provide makeup lessons or refunds for scheduled holidays.

Unexpected Cancellations

  • If a class is canceled due to instructor illness or unforeseen circumstances, students will be notified promptly via the OpenDance WhatsApp groups.
  • A makeup class will be scheduled at a later date. No monetary refunds will be issued for individual class cancellations where a makeup session is offered.

3. Attendance and Refunds

Attendance Responsibility

  • OpenDance is not responsible for a participant’s inability to attend. Monthly fees are non-refundable and non-transferable to future months if a student misses a class.

Interruption of Lessons

  • If classes are interrupted for reasons beyond the school’s control (e.g., public health emergencies, force majeure):
    • Students may choose compensation via virtual classes, makeup sessions after reopening, or a credit voucher.
  • Medical Refunds: OpenDance will only consider refunds for course fees if a student is unable to attend for a prolonged period due to a verifiable health reason, supported by a formal doctor’s certificate.

4. Workshop and Access Policy

  • OpenDance reserves the right to deny entry or cancel the registration of any individual whose behavior is disruptive, harassing, or negatively impacts the community.
  • Priority Access: Tickets for workshops are offered first to active OpenDance students.
  • Right of Admission: OpenDance reserves the right to enforce this policy at any time, including during events, to ensure the safety of all attendees.

5. Classroom Etiquette

  • Environment: Please maintain a peaceful and focused learning environment.
  • Technology: Mobile phones and music players must be silenced and put away during class.
  • Communication: Please keep social conversations outside of the studio floor to respect the instructor and fellow students.
  • Private Lessons: If your class follows a private lesson, please enter the studio quietly and wait in the designated area without interrupting the ongoing session.

6. Liability and Safety

  • Personal Belongings: OpenDance Madeira is not responsible for the loss, theft, or damage of any personal property on the premises.
  • Physical Safety: Dance is a physical activity. By participating, students acknowledge the inherent risks. OpenDance is not liable for any injuries, accidents, or physical harm sustained during classes, events, or while on the school premises.

7. Media and Intellectual Property

Promotional Media (GDPR Compliant)

  • OpenDance may take photographs or videos during classes and events for marketing purposes.
  • Consent: By enrolling, you consent to the use of your image in our promotional materials.
  • Opt-Out: If you do not wish to be filmed or photographed, you must notify the school in writing (madeiraopendance@gmail.com) before the start of your course.

Personal vs. Commercial Use

  • Recording photos/videos for personal use is generally permitted unless management states otherwise.
  • Commercial Use: Use of any media taken at OpenDance for commercial purposes (promoting other businesses, services, or events) is strictly prohibited without prior written consent from the management.

Use of Name

  • The use of the “OpenDance” name or logo to promote personal or third-party services is strictly prohibited without prior written consent.

8. Joint Ventures and Partnerships

  • These terms and conditions apply to all events organized by OpenDance Madeira, including those held in collaboration with external partners or companies.

9. Regulatory Information (Portugal)

  • Complaints: In accordance with Portuguese law, OpenDance Madeira maintains a Physical Complaints Book (Livro de Reclamações) on-site and access to the Electronic Complaints Book.
  • Data Protection: Your personal data is handled in accordance with the RGPD (GDPR) solely for administrative and communication purposes related to the school.
